Terms of Service

These Terms of Service ("Terms") govern your access to and use of Serplify's products, APIs, and website (together, the "Service"). By creating an account, generating an API key, or otherwise using the Service, you agree to these Terms. If you're agreeing on behalf of a company or other entity, you represent that you have authority to bind that entity, and "you" refers to that entity.

1. What Serplify is — and is not

Serplify provides (a) a SERP API that returns publicly available search-engine result data as structured JSON, and (b) traffic products (Website Traffic and SEO/CTR Traffic) that generate real, human-pattern web visits and clicks for measurement and testing. The Service is a general-purpose technical tool, comparable to a web browser, an analytics platform, or an HTTP client. It is neutral as to how you apply it.

Serplify is not a ranking service, an SEO guarantee, an ad network, or a manipulation product. We do not promise search rankings, traffic outcomes, revenue, or any specific business result, and nothing on our website, in our documentation, or in any communication should be read as such a promise.

2. Your account and API keys

You are responsible for your account, your API keys, and all activity conducted through them, whether or not authorized by you. Keep your credentials secure and notify us promptly at support@serplify.io if you suspect unauthorized use. You must be at least the age of majority in your jurisdiction and able to form a binding contract. You may not use the Service if you are barred from doing so under applicable law or are on a sanctions or denied-parties list.

3. Acceptable use and your responsibilities

Your use of the Service must comply with our Acceptable Use Policy, which is incorporated into these Terms by reference. In addition, you represent and warrant, on an ongoing basis, that:

• You have all rights, authorizations, and consents necessary for your use, including the right to send traffic to, or collect data about, any site or property you target.
• Your use complies with all applicable laws and regulations, and with the terms of service and technical limits of any third-party platform, search engine, or website you interact with through the Service.
• You will only request publicly available information through the SERP API and will not use it to access data behind a login, paywall, or other access control, or to collect personal data unlawfully.
• You will not use the Service to deceive, defraud, harm, harass, or infringe the rights of any person or entity.

You bear sole responsibility for your inputs and objectives — the keywords you query, the domains and URLs you target, the volume you request, and the purpose you apply the results to. Because the Service is configured and directed entirely by you, Serplify cannot and does not pre-screen or guarantee the legality of any particular use.

4. Lawful data collection

The SERP API collects information that is already public — the same results a person sees in a browser, gathered in an automated, good-faith manner. Accessing and compiling publicly available information is a lawful, well-established activity. You agree to use collected data responsibly, to respect intellectual-property and privacy rights, and not to use the Service to circumvent technical access controls or to build products that violate the rights of the sources. 5. Billing

• Usage-based products (such as the SERP API) are billed per unit consumed; only successful results draw down your balance. Prepaid balance and plan fees are charged in advance for the term or amount you select.
• Prices shown on the website are illustrative; the pricing that applies to you is the pricing shown in your account at the time of use.
• Fees are exclusive of taxes unless stated otherwise; you are responsible for any applicable taxes, duties, or withholdings.
• Except where required by law, fees and prepaid balances are non-refundable. Usage already incurred remains payable. You may stop using the Service at any time.
• We may suspend the Service for non-payment, chargebacks, or suspected fraud.

6. Service availability and changes

We work to keep the Service reliable and publish live status at status.serplify.io. Any specific uptime commitment applies only if it is expressly stated in your plan or a separate written enterprise agreement. We may add, change, deprecate, or remove features, and we may impose or adjust rate limits and quotas, at any time. We will use reasonable efforts to give notice of material changes.

7. Suspension and termination

We may suspend or terminate your access, with or without notice, if we reasonably believe you have violated these Terms or the Acceptable Use Policy, if required by law or a platform we depend on, or to protect the Service, other customers, or third parties. For serious or illegal abuse we may act immediately and, where appropriate, cooperate with law enforcement. You may terminate at any time by closing your account. Provisions that by their nature should survive termination (including Sections 8–12) will survive.

Serplify provides data and real traffic for testing and growth experimentation. Search engines and third-party platforms operate their own algorithms and policies, entirely outside our control. We do not guarantee search rankings, indexing, click-through improvements, conversions, or any specific commercial outcome, and any figures or examples we publish are illustrative, not promises.

10. Indemnification

You agree to defend, indemnify, and hold harmless Serplify and its officers, employees, and agents from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to (a) your use of the Service, (b) your inputs, targets, keywords, or objectives, (c) your violation of these Terms, the Acceptable Use Policy, or any law or third-party right, or (d) any content or destination you direct the Service toward. This reflects that you — not Serplify — choose and control how the Service is used.

11. Limitation of liability

To the maximum extent permitted by law, Serplify will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Service, even if advised of the possibility. Serplify's total aggregate liability for all claims relating to the Service will not exceed the amount you paid us in the three (3) months immediately before the event giving rise to the claim. Some jurisdictions do not allow certain limitations; in those places, the limitations apply to the fullest extent permitted.

12. Governing law and disputes

These Terms and any dispute arising from them are governed by the laws applicable at Serplify's principal place of business, without regard to conflict-of-laws rules, and you agree to the exclusive jurisdiction of the courts there, except where mandatory local law provides otherwise. You agree to first contact us to seek an informal resolution before commencing formal proceedings.

13. Miscellaneous

These Terms, together with the Acceptable Use Policy and Privacy Policy, are the entire agreement between you and Serplify regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

14. Changes to these Terms

We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date and, for material changes, provide reasonable notice. Your continued use of the Service after changes take effect means you accept the revised Terms.
